This policy applies to all customers who use the Second Phone iOS app.

This "Messaging Policy" outlines essential rules and regulations regarding the use of phone numbers obtained through the App, including requirements and restrictions on message content. It also describes mechanisms for detecting and preventing unwanted messaging to ensure compliance with applicable laws and regulations. Your adherence to this policy is crucial for using messaging services effectively. Failure to comply may result in account suspension or blocking, which includes loss of access to calling and messaging capabilities with the affected phone number.

Operational Messages

You acknowledge that you may receive operational text messages about the status of phone numbers obtained via the App, credits purchased for calling, or other service-related notifications, such as warnings and account suspension notices.

Detection and Prevention of Unwanted Messaging

To offer phone numbers and related services, including messaging, the App uses Twilio Inc. as its cloud communication service provider. Both the App and Twilio implement message filtering systems to safeguard messaging participants and prevent spam, fraud, abuse, and legal violations. All messages sent via numbers obtained through the App are subject to collection and monitoring.

Consent for Message Monitoring

By using the App, you authorize the App and Twilio Inc. to collect, process, store, and monitor the content of messages you send using these phone numbers for purposes including:

  • Preventing spam, abuse, and illegal or fraudulent activities.
  • Ensuring compliance with laws, regulations, and policies, including the Twilio Acceptable Use Policy and Messaging Policy.

Prohibited Content

The following categories of content ("objectionable content") are strictly prohibited and may result in account suspension or blocking:

  1. Spam: Repeated, unsolicited messages with similar or duplicate content sent to one or more recipients within a few days.
  2. High-Risk Financial Services: Content involving cryptocurrency, loans (e.g., payday loans, student loans), or similar services.
  3. Third-Party Lead Generation: Activities involving the collection, sale, or sharing of consumer information.
  4. Debt-Related Content: Debt collection, forgiveness, or credit repair.
  5. "Get Rich Quick" Schemes: Promotions of deceptive work-from-home opportunities or investment schemes.
  6. Cannabis, CBD, and Fireworks: Content related to substances or articles that are illegal in relevant jurisdictions, even if legal in certain regions.
  7. Prescription Medications: Offers for prescription drugs that are not sold over the counter.
  8. Gambling-Related Content: Messages about gambling apps or websites.
  9. "S.H.A.F.T." Content: Content involving sex, hate, alcohol, firearms, or tobacco. This includes explicit prohibition of sex-related and hate speech content and additional restrictions on alcohol and tobacco messages.
  10. Evasion of Filters: Use of misspelled words, leetspeak, or similar techniques to bypass filters.
  11. Links: Messages with URLs, especially shortened links, which are often flagged as fraudulent.
  12. Fraudulent or Malicious Content: Content involving scams, phishing, or malware.
  13. Violent, Abusive, or Harassing Content: Hate speech, profanity, defamation, or harassment.
  14. Explicit or Adult Content: Pornography, adult entertainment, or human trafficking.
  15. Other Prohibited Content: Illegal, harmful, inappropriate, or misrepresented content.

Consent Requirements

Before sending messages using phone numbers obtained via the App, you must ensure recipient consent:

  1. Business Relationships: Maintain records of consent (e.g., signed forms, timestamps). Consent must be specific to the type of communication and cannot be shared between senders.
  2. Implied Consent: Applies when a recipient voluntarily provides their number and engages in actions such as placing orders, setting up alerts, or scheduling appointments.
  3. Private Relationships: Verbal consent suffices for personal contacts. If a recipient has not expressed disagreement, consent is implied.

Twilio Inc., as a data processor, may collect and monitor your message content to detect spam, fraud, or abuse. Additionally, the App uses Hive, an AI-powered content moderation service, to enhance message filtering across multiple categories, including sexual content, violence, hate speech, and spam.
